Shipping Conditions
Introduction
Stogger Engineering BV ships professional turf care equipment, LED grass grow light systems, compact units, large light rigs, robots, turf fans, ventilation systems, cables, spare parts and accessories, to customers across Europe and worldwide. Our products vary significantly in size, weight and transport requirements, from small courier packages to full container loads for major stadium projects.
These Shipping Conditions explain how we handle transport, what we arrange, and what our customers are responsible for. The exact shipping condition applicable to your order is always confirmed in the quotation, order confirmation or written agreement.
Scope of These Shipping Conditions
These conditions apply to all shipments made by Stogger Engineering BV from our warehouse in the Netherlands, unless explicitly agreed otherwise in writing. All shipments are made under Incoterms® 2020 as specified per transport type below.
Incoterms® 2020 are internationally recognised trade terms published by the International Chamber of Commerce. They define the point at which risk and costs transfer from seller to buyer. They do not replace the sales contract. The applicable Incoterm is always specified in the quotation or order confirmation.
Our products are valuable, fragile and theft-sensitive. All shipments are made via closed transport, enclosed trucks, sealed containers or equivalent, unless otherwise agreed in writing.
Shipping Methods Used by Stogger
Depending on the product, destination and project requirements, we use the following transport methods:
- Road transport within the EU
- Road transport to non-EU destinations
- Sea freight / container shipments
- Air freight
- Courier services — DHL Express, UPS or equivalent
- Customer-arranged transport (FCA or EXW)
EU Road Transport
Condition: DAP [named place of destination] — Incoterms® 2020
For deliveries within the European Union, we ship on a DAP basis. Stogger arranges and pays for road transport to the agreed destination. Risk transfers to the buyer when the goods are made available for unloading at the named place.
The buyer is responsible for:
- Unloading at the delivery address
- Ensuring safe and suitable access for the delivery vehicle
- Providing adequate unloading equipment (forklift, tail lift, crane or loading dock) and qualified personnel
- Any waiting time, re-delivery costs or additional charges caused by inaccessible premises or absent personnel
Non-EU Road Transport
Condition: CIP [named place of destination] — Incoterms® 2020
For road transport to destinations outside the European Union, including Switzerland, the United Kingdom, Norway, Turkey and other non-EU countries, we ship on a CIP basis. Stogger arranges road freight and cargo insurance to the agreed destination. Risk transfers to the buyer when the goods are handed to the first carrier at our warehouse.
The buyer is responsible for:
- Import customs clearance in the country of destination
- Import duties, taxes and VAT
- Appointing and paying a local customs broker or import agent
- Any waiting time, border delays or costs arising from customs procedures or incomplete import documentation
- Unloading and inland delivery at destination
Any costs or delays at border crossings caused by factors within the buyer's responsibility, including missing documentation, absence of an import agent or unavailability of a customs broker, are for the buyer's account and risk.
Sea Freight / Container Transport
Condition: CIF [port of destination] — Incoterms® 2020
For international container shipments, Stogger ships on a CIF basis. We arrange and pay for sea freight from our loading port to the named port of destination, handle export formalities, and provide marine cargo insurance.
Stogger arranges and pays:
- Sea freight to the named port of destination
- Export customs clearance and export documentation
- Marine cargo insurance
The buyer is responsible for:
- Import customs clearance and all required import documentation
- Import duties, taxes, VAT and all local levies
- Appointing and paying a licensed local import agent or customs broker
- Port unloading and terminal handling at the port of destination
- Terminal handling charges, port fees and any local surcharges after vessel arrival
- Demurrage, detention, terminal storage and port congestion surcharges
- Any waiting time or costs caused by delays in customs clearance, late document submission or absence of an import agent
- Inland transport from the port of destination to the final site
Stogger does not offer DAP as a standard condition for sea freight shipments. Under DAP, costs such as demurrage, detention and port storage accumulate after vessel arrival and fall to the seller, outside Stogger's control. DAP for sea freight is only available by explicit prior written agreement and subject to additional conditions.
DAP Sea Freight — Exception Only
DAP terms for sea freight are only available by explicit prior written agreement. If DAP is agreed for a sea freight shipment, the following conditions always apply in addition to the standard DAP terms:
The buyer is solely responsible for import customs clearance, the appointment of a licensed customs broker or import agent, and payment of all duties, taxes and VAT. Any demurrage, detention, terminal storage, port congestion charges or waiting time arising after arrival of the vessel at the port of destination, including delays caused by customs procedures, missing documents or buyer readiness, shall be for the buyer's account and risk. If Stogger is requested to arrange or advance any of these costs on behalf of the buyer, all related charges, third-party fees and expenses will be invoiced directly to the buyer and remain entirely for the buyer's account.
Air Freight
Condition: agreed in writing per shipment — CIP, CPT or FCA
Air freight is used for compact units, urgent shipments or specific international deliveries. The applicable shipping condition for each air freight shipment is agreed in writing and confirmed in the quotation or order confirmation.
Unless explicitly agreed otherwise, the buyer remains responsible for import customs clearance, duties, taxes, VAT and local handling at the destination airport.
Courier Shipments and Spare Parts
Condition: DAP [delivery address] — DHL Express, UPS or equivalent
Small shipments including spare parts, cables, controllers and accessories are dispatched via courier services on a DAP basis to the delivery address.
The buyer is responsible for:
- Import duties, taxes and VAT at the destination
- Any customs holds, inspections or clearance delays
- Costs arising from incorrect or incomplete delivery address information
- Refused delivery, failed delivery attempts or return freight charges
- Storage costs if the shipment cannot be delivered
Stogger reserves the right to invoice the buyer for any costs charged back to Stogger by the carrier as a result of the above.
Customer-Arranged Transport
Condition: FCA Stogger warehouse — Incoterms® 2020 (preferred) | EXW Stogger warehouse — Incoterms® 2020 (on specific request)
If the customer, dealer or importer wishes to arrange their own transport, we offer two options:
FCA Stogger warehouse (preferred for international shipments)
Goods are loaded onto the buyer's nominated carrier at our warehouse. Stogger handles export formalities and documentation. Risk transfers when the carrier takes possession. This is our preferred arrangement for international shipments as it ensures correct export compliance from the Netherlands.
EXW Stogger warehouse (on specific request only)
Goods are made available at our warehouse for collection. The buyer is responsible for loading, all transport, export formalities, insurance and import compliance. Under EXW, the buyer assumes full export compliance responsibility under Dutch and EU law. We recommend FCA over EXW for international shipments.
For both FCA and EXW, all transport costs, insurance, import duties, taxes and related risks are entirely for the buyer's account from the agreed point of handover.
Importer, Customs Broker and Local Import Agent
For all shipments outside the European Union, the buyer is responsible for ensuring that a licensed import agent, customs broker or importer of record is in place in the country of destination before shipment.
If the customer does not have an importer, customs broker or local import agent available, Stogger may assist in arranging such support on behalf of the customer. Any costs arising from this assistance, including broker fees, disbursements, duties, taxes, waiting time, storage charges and all other third-party fees, will be charged directly to the customer and remain entirely for the customer's account and risk. Stogger Engineering BV does not accept liability for delays, losses or additional costs caused by the absence or unavailability of an import agent.
Costs Caused by Delays, Customs, Storage or Waiting Time
The following charges are always for the buyer's account and risk, regardless of the shipping condition applied, unless explicitly agreed otherwise in writing:
- Demurrage and detention — arising from containers or equipment not collected or returned within the agreed free time
- Terminal storage — port or terminal storage costs after vessel arrival
- Port congestion surcharges — additional carrier charges due to congestion at the destination port
- Customs delays — costs or waiting time caused by customs inspection or delays in import clearance at the buyer's end
- Border waiting time — waiting time at customs checkpoints caused by import procedures or missing documents on the buyer's side
- Failed or delayed delivery — additional transport, storage or handling costs caused by incorrect address information, refused delivery or buyer unreadiness
Where Stogger has advanced any of the above costs on behalf of the buyer, reimbursement will be invoiced immediately upon receipt of the relevant charge.
Unloading and Site Readiness
For all deliveries, the buyer must ensure:
- The delivery address is accessible for the type of vehicle used
- Adequate unloading equipment is available — forklift, tail lift, crane or loading dock
- Qualified personnel are present at the agreed delivery time
- Any required permits or site access arrangements are in place in advance
Waiting time, failed delivery attempts or additional costs caused by inadequate site readiness will be charged to the buyer.
DDP and Special Delivery Arrangements
Delivered Duty Paid (DDP) is not a standard Stogger shipping condition and is in practice almost never used. Stogger does not assume responsibility for import duties, VAT, local taxes or customs compliance in the buyer's country under standard trading terms.
In the exceptional case that DDP is agreed, the following conditions always apply:
- The buyer must transfer an estimated amount covering expected import duties and local import costs to Stogger prior to shipment.
- DDP must be explicitly agreed in writing and confirmed in the order confirmation or contract.
- Any costs exceeding the estimated import duties will be invoiced directly to the buyer after delivery.
- Any quotation or order confirmation that does not explicitly state DDP terms should be understood to exclude DDP.
Final Note
The applicable shipping condition, including the Incoterm® 2020, named place or port, and any special arrangements, is always specified in the quotation, order confirmation or written agreement. In case of conflict, the written agreement between Stogger and the customer shall prevail.
